DWI and Traffic Violations

Traffic violations can have serious consequences, particularly when a driver is accused of driving under the influence. A conviction on DWI charges may result in fines, the revocation or suspension of your driver's license, and possible jail time. Second and third offenses for DWI carry automatic jail time. In addition, your insurance company may increase your rates to an unmanageable level.

In defending against an impaired driving charge, you have many rights as a defendant in Municipal Court, including the right to cross-examine the witnesses against you, even if they are police officers. An experienced defense attorney can make all the difference in such a difficult case.

The facts and circumstances of each case differ. Our office utilizes qualified experts to dispute the validity or accuracy of Standardized Field Sobriety Tests (SFSTs) conducted by arresting police officers, and to contest the reliability and admissibility of breathalyzer results.

Recent changes in the law have reduced the threshold for DWI to a .08 BAC reading. The additional potential consequences of a DWI conviction, including a $3000 ($1000 per year for three years) Surcharge, the potential requirement of an interlock device to all vehicles in the household, jail, and loss of license, make consulting with an attorney an important step in dealing with the charges. The decision to hire an attorney, and which attorney to hire is not always easy. Our office offers a free consultation to assist you in understanding all charges against you, their potential consequences, and your rights under the US and NJ Constitutions, as well as the New Jersey Rules of Court.

In addition to DWI defense, we regularly defend those charged with moving violations, including speeding, reckless driving, and careless driving. We are also able to assist those facing charges of Driving While Suspended or Revoked, Driving Without Insurance, or facing other document related charges with a risk of license suspension. Mr. Simon is a former municipal public defender and has over fourteen years of experience in this area of the law.
